A guilty plea or a jury verdict finding you guilty is not the final chapter in a criminal case. Both state and federal law guarantee several safeguards that must be honored for a criminal conviction to stand. Every year, numerous convictions are reversed because the previous attorney, the prosecutor, or even the judge failed to observe one of these safeguards.
Mr. Dowling has argued, or been on the appellate team in a number of high-stakes federal criminal appeals. He was the principal brief writer in a winning federal appeal involving a New York City crime family. The case was decided by the U.S. Court of Appeals for the Second Circuit and resulted in a precedential opinion in a matter of first impression in the circuit.
Mr. Dowling was also part of the appellate team in a high-stakes federal criminal appeal involving an insurance executive and political consultant who were convicted of wire fraud and federal bribery offenses. The U.S. Court of Appeals for the Fourth Circuit reversed the convictions and remanded the case back down for a new trial.
He is admitted to practice in federal appellate courts across the country, including the U.S. Court of Appeals for the Second Circuit in New York City, the Third Circuit in Philadelphia, and the Fourth Circuit in Richmond, Virginia. In 2024, Mr. Dowling is slated to argue federal criminal appeals in all three of these courts.
