Second Amendment

Criminal Defense

Mr. Dowling routinely defends those accused of firearms crimes in state and federal court. Federal law authorizes devastating penalties for violations of firearms laws. These criminal statutes include engaging in the business of dealing firearms without a license, being a felon in possession of a firearm, possessing a firearm in furtherance of a drug crime, and straw purchasing.

Often, judges, juries, and prosecutors do not understand the nuances of various firearms and their capabilities. As an avid firearms enthusiast himself, Mr. Dowling appreciates these features and uses his knowledge of firearms to make compelling arguments for the defense.

Recently, Mr. Dowling represented a state trooper charged in federal court with dealing in firearms without a license. If convicted at trial, the trooper was looking at up to ten years in federal prison. Mr. Dowling and another attorney were able to secure a resolution that involved a significantly lower punishment. In another case, a client was sentenced to federal prison for carrying a firearm in connection with a drug trafficking crime. Mr. Dowling was able to secure the client’s early release from prison.

Restoration of Gun Rights

Upon conviction of a felony, federal law provides that you forfeit your Second Amendment rights. There are options available to seek restoration of those rights and Mr. Dowling frequently advises clients on this process.

Counseling for Licensed Dealers

Mr. Dowling also provides counseling to licensed federal firearms dealers (“FFLs”). FFLs are subject to heightened oversight in how they handle firearms, who they sell them to, background checks, record keeping, and the like. Mr. Dowling advises FFLs on best practices to avoid scrutiny from the ATF and how to avoid fines and even criminal charges.
